PUBLIC OFFER – DVA FILMS
1. General Information
DVA FILMS provides professional wedding photography, wedding videography, engagement photography, Save the Date sessions, Trash the Dress sessions and related visual content services.
The information presented on this website is intended to provide general information about the services offered by DVA FILMS. The exact services, package, price, schedule, deliverables and other contractual conditions applicable to a specific event shall be established in the agreement concluded between DVA FILMS and the client.
The photographs, videos, descriptions, prices and package details displayed on the website may be updated from time to time.
2. Services
DVA FILMS offers, depending on availability and the selected package:
- wedding photography;
- wedding videography and cinematic wedding films;
- engagement and Save the Date photography;
- Trash the Dress sessions;
- additional photography or cinematography hours;
- second photographer or cinematographer services;
- wedding albums and other photographic products;
- drone photography and videography, where legally and technically possible;
- other services expressly agreed with the client.
The exact services included in each package are those presented in the current offer and/or expressly agreed in writing with the client.
3. Availability and Booking
The availability of a date is not guaranteed until it has been confirmed by DVA FILMS and the parties have concluded the applicable agreement.
A booking becomes effective according to the conditions specified in the agreement, including, where applicable, the payment of the agreed booking deposit.
A date may be reserved for another client until the booking process has been completed.
4. Prices and Payment
The prices displayed on the website represent the current public offer and may be changed without prior notice for future bookings.
The price applicable to a specific event is the price agreed with the client at the time of booking and recorded in the agreement or written confirmation.
Additional services not included in the selected package may be charged separately according to the prices communicated by DVA FILMS and accepted by the client.
Payment terms, booking deposit, remaining balance and payment deadlines shall be specified in the agreement concluded between the parties.
5. Changes and Cancellation
Any request to change the event date, services or package must be communicated to DVA FILMS as soon as possible.
Changes are subject to availability and may result in additional costs where applicable.
Cancellation of a booking and the financial consequences of cancellation shall be governed by the agreement concluded between DVA FILMS and the client and by the applicable legislation.
Where a booking deposit or advance payment has been made, its treatment in the event of cancellation shall be determined according to the contractual terms and applicable law.
6. Event Coverage
The client is responsible for providing DVA FILMS with accurate information regarding the event schedule, locations, ceremony, reception and other relevant details necessary for the proper performance of the services.
DVA FILMS will make reasonable efforts to capture the important moments of the event. However, the complete capture of every guest, moment or activity cannot be guaranteed due to the nature of live events, venue restrictions, lighting conditions, weather, schedule changes, guest interference or other circumstances beyond the reasonable control of the photographer or cinematographer.
DVA FILMS reserves the right to make professional creative decisions regarding composition, framing, editing, colour grading and artistic style, in accordance with the selected service.
7. Delivery of Materials
The final photographs and/or films will be delivered within the timeframe specified in the selected package or agreement.
Delivery times may be affected by circumstances such as the complexity of the project, the number of photographs and videos, additional services, revisions requested by the client or circumstances beyond the reasonable control of DVA FILMS.
The final delivery method may include a private online gallery, digital download, physical products or another method agreed with the client.
8. Image Selection and Editing
DVA FILMS retains professional and artistic discretion regarding the selection and editing of the final photographs and video material.
The delivery of all captured files, including duplicate, test, unsuccessful, technically defective or unselected material, is not guaranteed unless expressly included in the agreement.
RAW files and unedited video footage are not included in the standard services unless expressly agreed in writing.
9. Copyright and Intellectual Property
All photographs, films, video footage, graphic materials and other creative works produced by DVA FILMS are protected by applicable copyright and intellectual property legislation.
Copyright and intellectual property rights remain with the author/rightsholder unless otherwise expressly agreed in writing.
The client receives the usage rights expressly agreed in the contract. The purchase of a photography or videography service does not automatically transfer copyright or all intellectual property rights to the client.
The client may not commercially reproduce, sell, license, modify or otherwise exploit the delivered works beyond the agreed personal use without prior written permission from DVA FILMS, unless otherwise provided by the agreement or applicable law.
10. Portfolio and Promotional Use
DVA FILMS may use selected photographs and video excerpts from an event for its portfolio, website, social media, advertising, competitions, publications and other promotional purposes only to the extent permitted by the applicable agreement and applicable law.
Where the client has expressly requested that images or video materials not be used for promotional purposes, DVA FILMS will respect the applicable contractual arrangement.
11. Client Responsibilities
The client is responsible for providing accurate information and communicating relevant requirements before the event.
The client should inform DVA FILMS in advance about any specific restrictions, important people, moments or situations that require particular attention.
DVA FILMS shall not be responsible for missed moments resulting from information not communicated in advance, changes to the event schedule, venue restrictions, delays or circumstances beyond its reasonable control.
12. Force Majeure and Unforeseen Circumstances
Neither party shall be held responsible for failure or delay in performing contractual obligations caused by circumstances beyond its reasonable control, including natural disasters, severe weather, accidents, serious illness, government restrictions, acts of war, public emergencies, technical failures beyond reasonable control or other force majeure events.
In such situations, the parties will make reasonable efforts to find an appropriate solution, including rescheduling the services where reasonably possible.
13. Complaints
Any complaint regarding the services or delivered materials should be communicated to DVA FILMS within a reasonable period after the client becomes aware of the relevant issue.
DVA FILMS will review the complaint and attempt to resolve the matter amicably.
Nothing in these terms limits any mandatory rights granted to consumers under applicable law.
14. Personal Data
Personal data provided by clients or visitors through the website, contact forms or other communication channels is processed in accordance with the DVA FILMS Privacy Policy and applicable data protection legislation.

15. Applicable Law
The relationship between DVA FILMS and its clients shall be governed by Romanian law, without prejudice to mandatory consumer protection provisions applicable to consumers.
Any dispute shall first be addressed amicably between the parties. Where an amicable resolution cannot be reached, the dispute may be submitted to the competent courts in accordance with applicable law.
16. Final Provisions
The information contained in this Public Offer does not replace the individual agreement concluded between DVA FILMS and the client.
In the event of a conflict between this Public Offer and the individual agreement, the provisions of the individual agreement shall apply to the extent permitted by law.
DVA FILMS reserves the right to update this Public Offer when necessary. The version applicable to a specific booking shall be the version accepted by the client at the relevant time, subject to applicable law.
